The window is the easy part — these also apply

  • Prior express written consent is required for marketing calls using an autodialer or an artificial or prerecorded voice — which includes AI voice agents.
  • Identify the caller and the business on whose behalf the call is made.
  • Honour do-not-call requests immediately and maintain an internal suppression list.
  • Statutory damages run to $500 per violation, and $1,500 where the violation is wilful.

National Do Not Call Registry: Scrub before dialling. State registries may apply on top of the federal list.

Stricter than the national rule

  • Florida: Solicitation ends at 8pm local, no Sunday calling, and a limit of three calls per number per day (SB 1120).
  • Oklahoma: Solicitation ends at 8pm local rather than 9pm.

How this is calculated

Calling windows are defined in local time where the recipient is, not where you are dialling from. Beyond the window sit the duties that actually generate penalties: registry scrubbing, consent records, caller identification and honouring opt-outs.

Every window here is defined in local time where the person you are calling is, not where you are dialling from. A 9am call out of London lands at 4am in New York and is a violation, however reasonable the hour looked on your side. Any dialler working across time zones needs the recipient's local time as an input, not the caller's.

The headline numbers: the US federal window is 8am–9pm, with Florida and Oklahoma cutting off at 8pm and Florida banning Sunday solicitation outright. India runs 9am–9pm. The UK allows 8am–9pm on weekdays and Saturdays but only 9am–6pm on Sundays. Canada runs to 9:30pm on weekdays and 10am–6pm at weekends. Australia stops at 8pm on weekdays, 5pm on Saturdays, and permits no telemarketing on Sundays or public holidays.

It is about consent you cannot evidence, a number you should have scrubbed against a preference register, a caller identity you failed to give, or an opt-out you did not honour. Those duties apply at every hour of the day, and in India they extend to registering on the DLT platform and using the mandated numbering series before a single call goes out.
